Fresh-B Privacy and Personal Data Protection Policy
Fresh-B places the protection of personal data at the heart of its mission and the services it offers you.
This Policy sets out the principles and guidelines for the protection of your Personal Data and aims to inform you about:
- The Personal Data that Fresh-B collects and the reasons for this collection,
- How this Personal Data is used,
- Your rights regarding your Personal Data.
This Policy applies to all Fresh-B services, excluding any partner websites.
1. How does Fresh-B take Personal Data protection into account?
Fresh-B is committed to considering the protection of your Personal Data and your privacy from the design stage of any new products or services offered to you. To this end, measures are being implemented to ensure the protection of your Personal Data, in particular to ensure its security and to guarantee respect for and the proper exercise of your rights.
2. What personal data does Fresh-B use?
Fresh-B is committed to collecting only the data strictly necessary for providing the subscribed services.
If optional data is requested, Fresh-B will clearly inform you which Personal Data is necessary for providing the subscribed service and which data you voluntarily provide.
Personal Data is collected directly from you and is used only for the purposes that have been brought to your attention.
Personal data is used to offer you other services only if you have agreed to receive marketing communications.
3. How is the Personal Data of minors collected?
Some services may be used by minors. In this case, minors must obtain the consent of their parents or legal guardians.
4. Which services or companies share your Personal Data with?
Your data may be shared:
- Internal Fresh-B departments: the departments responsible for providing the services you have subscribed to, including Customer Service and Sales Administration;
- External Fresh-B service providers: technical service providers, including subcontractors;
- Fresh-B business partners, after informing you beforehand and allowing you to express your preferences via a checkbox.
Can your Personal Data be transferred outside the European Union?
Fresh-B processes all your Personal Data within the territory of the European Union (EU).
However, for certain specific services, Fresh-B may use subcontractors located outside the EU. Some Personal Data may then be shared with them strictly for the purposes of their assigned tasks. In this case, in accordance with applicable regulations, Fresh-B requires its subcontractors to provide the necessary guarantees for the management and security of these transfers, in particular by signing standard contractual clauses approved by the European Commission.
6. How long does Fresh-B keep your Personal Data?
The retention period for your Personal Data depends on the service subscribed to. Fresh-B undertakes not to keep your Personal Data beyond the period necessary for providing the service, plus the retention period required by applicable legal statutes of limitations.
7. Is your Personal Data protected?
Fresh-B is committed to taking all necessary measures to ensure the security and confidentiality of Personal Data, and in particular to prevent it from being damaged, deleted, or accessed by unauthorized third parties.
In accordance with Fresh-B's commitments, the traceability of actions is monitored, and the processing carried out may be subject to audit.
Furthermore, in the event of a security incident affecting your Personal Data (destruction, loss, alteration, or disclosure), Fresh-B is committed to complying with the obligation to notify Personal Data breaches, in particular to the CNIL (French Data Protection Authority).
8. What are your rights regarding your Personal Data?
You have the right to exercise your rights under applicable data protection regulations with Fresh-B at any time, subject to meeting the necessary conditions:
- Right of access: you can obtain a copy of your Personal Data being processed by Fresh-B;
- Right to rectification: you can update your Personal Data or have your Personal Data processed by Fresh-B rectified;
- Right to object, in particular to receiving marketing communications: you can express your wish to no longer receive marketing communications from Fresh-B or request that your Personal Data no longer be processed;
- Right to erasure: you can request the deletion of your Personal Data;
- Right to restriction of processing: you can request the suspension of the processing of your Personal Data;
Right to data portability: You can request that Fresh-B provide you with your Personal Data so that you can use it elsewhere.
When you subscribe to a service or when your Personal Data is collected, you will be informed of the address (postal and/or email) to which you should send your request to exercise your rights.
All requests must be accompanied by proof of identity. Fresh-B undertakes to respond to your requests to exercise your rights as quickly as possible and in any event within the legal time limits.

Each term beginning with a capital letter has the meaning given to it below.
"Privacy and Personal Data Protection Policy" and "Policy": refers to this Policy describing the measures taken for the processing, use, and management of your Personal Data and your rights as a data subject.
"Personal Data": Refers to any information relating to you that allows you to be identified directly or indirectly.
“Processing”: Refers to any operation or set of operations performed on your Personal Data.
“Data Controller”: Refers to the Fresh-B entity that processes your Personal Data.
“Personal Data Breach”: Refers to a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, your Personal Data.
“Recipient”: Refers to the department or company that receives and may access your Personal Data.
